How the RERA rental index and Decree 43 work

Decree No. 43 of 2013, issued on 18 December 2013, caps how much rent can rise when a lease is renewed in Dubai. The cap depends on one number: how far your current rent is below the average rent for similar units.

That average comes from the Dubai rent index approved by RERA, the regulator inside the Dubai Land Department (Article 3). Since 2 January 2025 this is the Smart Rental Index 2025. DLD describes it as a building classification system: each building is assessed on its construction and finish, location and services, using registered rent contracts. DLD's FAQ says it covers all residential areas except DIFC and is updated once a year.

If your rent is up to 10% below the average, or above it, no increase is allowed. Further below the average, the cap rises in steps to a maximum of 20% (table above). The decree applies to all landlords, including free zones.

The landlord must ask for the increase in a notice at least 90 days before the lease ends. If the parties cannot agree, the Rental Disputes Center can set a fair rent. Older guides mention a two-year freeze on increases; that rule came from the 2007 text and was removed by Law No. 33 of 2008.

Questions

How much can my landlord increase the rent in Dubai?

At renewal, between 0% and 20%, depending on how far your rent is below the RERA index average for similar units: up to 10% below, 0%; 11–20% below, 5%; 21–30%, 10%; 31–40%, 15%; more than 40% below, 20% (Decree No. 43 of 2013).

Where do I find the RERA rental index for my unit?

In the Rental Index service on the Dubai Land Department website or in the Dubai REST app. Since January 2025 it is called the Smart Rental Index.

How much notice does the landlord need to give for a rent increase?

At least 90 days before the lease ends, unless the contract says otherwise (Law No. 26 of 2007, Article 14, as amended).

Is there a two-year rule before rent can go up?

Not any more. The original 2007 law barred increases for two years; Law No. 33 of 2008 replaced that article and the current text has no such bar.

What if I disagree with the increase?

Try to agree with the landlord first. If not, either side can file at the Rental Disputes Center; see our rental disputes guide for fees and steps.
